Art collections. Boon or curse for philanthropic opportunities in Belgium?
Art philanthropy can be defined as voluntary private contributions with the primary intention of promoting the public good, and takes on several forms. The best-known form of art philanthropy is the private legal act of bequeathing artworks or entire art collections to public institutions. Gifts are the oldest form of art patronage. However, a new generation of philanthropists is gaining momentum. They set up public-private partnerships, or they are no longer partners with museums, but are developing new concepts and visions. The main achievements of this new generation of philanthropists iare the creation of private-public partnerships or private museums. Finally, many initiatives aimed at democratizing the art market have recently also been launched. This chapter focuses primarily on the rules that govern the legal relationship between the art collector and the public museum, but it also briefly addresses the legal interests of collectors who engage in new forms of philanthropy.
